The build-up to the highly anticipated India vs Pakistan Asia Cup encounter has taken a dramatic turn off the field. With the clash scheduled for September 14, a public interest litigation (PIL) seeking its cancellation was swiftly thrown out by the Supreme Court on Thursday.
The petition, filed under Article 32 of the Constitution by four law students led by Urvashi Jain, argued that allowing India to play Pakistan was &ldquo;draconian&rdquo; and prejudicial to the interests of the nation. The plea linked the match to recent violence in Kashmir, alleging that sporting ties with Pakistan dishonoured the sacrifices of soldiers and civilians.
But the bench, comprising Justices JK Maheshwari and Vijay Bishnoi, refused to entertain the case. The judges made it clear that the court had no reason to intervene, noting simply that &ldquo;it is just a match.&rdquo;
The controversy comes against the backdrop of India&rsquo;s long-standing position on sporting ties with Pakistan. A month earlier, the government reiterated its policy of not participating in bilateral sporting events with its neighbour. However, it drew a clear distinction when it came to international and multilateral tournaments.
&ldquo;Indian teams will not be participating in competitions in Pakistan. Nor will we permit Pakistani teams to play in India,&rdquo; the statement clarified. &ldquo;With regard to international and multilateral events, in India or abroad, we are guided by the practices of international sports bodies and the interests of our own sportspersons.&rdquo;
This framework allows matches like the upcoming Asia Cup clash to go ahead, as the tournament falls under a multilateral event governed by the Asian Cricket Council.
Despite the PIL&rsquo;s strong language and emotional appeal, the court&rsquo;s dismissal underlined that cricketing fixtures, especially those sanctioned by international sporting bodies, remain outside the realm of constitutional litigation. For fans and players alike, the decision clears the way for the marquee match in what is always one of the sport&rsquo;s most watched rivalries.
