The Supreme Court on Friday rejected the bail plea of Mihir Shah, 24, the accused in the July 2024 Mumbai BMW hit-and-run case, remarking that &ldquo;such boys&rdquo; need to be taught a lesson.
A bench of Justices Dipankar Datta and AG Masih observed that parents are responsible for their children&rsquo;s conduct, adding, &ldquo;We have not been able to train our wards.&rdquo; The bench also highlighted that Shah comes from a wealthy family, with his father, Rajesh Shah, being a businessman and former leader of the Shiv Sena.
&ldquo;What does he do? He comes home late at night in a Mercedes, parks it in the shed, takes the BMW, crashes it, and goes absconding. In this case, let him be inside,&rdquo; the bench said.
Shah was allegedly speeding on Worli Sea Face Road in Mumbai when his BMW struck a couple riding a scooter. Despite hearing their screams, Shah allegedly continued driving. The male rider, Pradeep Nakhwa, survived after falling off the car&rsquo;s bonnet, while his wife died after her body was dragged nearly two kilometres.
Shah&rsquo;s lawyer told the court that the high court had allowed him to seek bail after recording evidence from key witnesses. The Supreme Court allowed Shah to withdraw his bail plea.
Investigations revealed that Shah was intoxicated at the time of the accident. He was arrested two days later. Authorities also arrested his father and the family driver for allegedly helping Shah evade law enforcement.
The high court had previously rejected Shah&rsquo;s bail plea, citing the gravity of the offence, the possibility of influencing witnesses, and tampering with evidence. Shah faces a maximum punishment of life imprisonment under the Bharatiya Nyaya Sanhita Section 105 (culpable homicide not amounting to murder).
