A Kolkata lower court on Wednesday rejected the plea filed by the parents of the RG Kar rape and murder victim seeking permission to survey the crime scene where their daughter, a young woman doctor, was assaulted and killed.
The judge observed that allowing the parents to visit the scene could lead to a parallel investigation, something lower courts are not authorised to permit. However, the court added that the parents may approach a higher court, which has the jurisdiction to entertain such a petition.
Earlier, the parents had moved a single-judge bench of the Calcutta High Court, where the CBI&mdash;the investigating agency&mdash;did not object to the proposed visit. However, Justice Tirthankar Ghosh directed them to first approach the trial court, which had sentenced the sole convict, civic volunteer Sanjay Roy, to life imprisonment in January.
The West Bengal government opposed the plea, as did legal representatives of Sandip Ghosh (former RG Kar principal) and Abhijit Mondal (former officer-in-charge of Tala Police Station), both accused of tampering with evidence in the case.
The trial court questioned the CBI&rsquo;s silence on the matter, even as objections were raised by others. Despite the rejection, the judge clarified that the family still had the right to appeal to a higher court.
The case continues to evoke public attention due to the brutality of the crime, the alleged institutional cover-up, and the family's continued legal battle for transparency.
