A sessions court in Arunachal Pradesh has sentenced a 23-year-old man to life imprisonment for raping his 19-year-old cousin sister in 2022. The Papum Pare district court in Yupia described the act as a &ldquo;sin and social taboo&rdquo; that warrants the harshest punishment.
Sessions Judge Hirendra Kashyap convicted the accused under Section 376(2)(f) of the Indian Penal Code, which deals with rape by a relative or a person in a position of trust. The court said the convict had &ldquo;abused his role as an elder brother&rdquo; and committed one of the &ldquo;rarest of rare&rdquo; crimes in the state&rsquo;s social context.
Public Prosecutor O. Binggep presented medical, forensic, and eyewitness evidence, including DNA samples from the bedsheet, which confirmed the assault. Rejecting the plea for leniency, the judge ruled that the convict was not entitled to probation or relief under Section 360 of the CrPC or the Probation of Offenders Act.
The court also directed the District Legal Services Authority to compensate the survivor under the Arunachal Pradesh Victim Compensation Scheme, 2011. The convict was sentenced to life imprisonment and fined ₹20,000. He has been informed of his right to appeal before the Gauhati High Court.
