The debate on the bill to make software professionals work 14 hours a day has gained momentum in Karnataka. As the BJP attacked the Siddaramaiah government of the Congress, the government seems to be on the back foot. The Labor Minister said that we are under pressure from the IT industry.
But we will evaluate it and decide. The government has taken a U-turn on the bill providing for 14-hour working day for IT employees in Karnataka. Labor Minister Santosh Lad clarified that there is pressure from the IT industries to legislate for people in the tech sector to work more hours.
But they are evaluating the matter. Ladd said the government is still examining the bill. Which will force software professionals to work 14 hours a day. BJP has opposed this bill.
BJP says that this issue needs to be discussed. Government cannot take a unilateral decision. IT sector employees and trade unions have already protested. Due to opposition, the government could not reach any conclusion on the bill.&nbsp;
Resentment among IT employees :&nbsp;
Santosh Lad said, I want all industrial heads to discuss this. Because this issue is in public domain. People are free to express their opinions. Dissatisfaction is being seen among IT employees as the matter has become public. He added that I want people to share their views. Based on that we will definitely pay attention. The minister said that IT companies, owners and directors should come forward and discuss the issue of work-life balance. Whether the feedback is positive or negative, the government will consider what needs to be done.
What is in the new bill ? : 
The state government is planning to amend the 'Karnataka Shops and Commercial Establishment Act, 1961'. The new bill will allow employees working in the IT/ITES/BPO sector to work more than 12 hours a day. 70 hours per week can be worked. Cannot be allowed to work more than 125 hours in three consecutive months. However, it is not clearly mentioned. According to the Karnataka State IT/ITES Employees Union (KITU), the new draft bill allows for 14 hours of work per day. This will completely change the existing law. At present a maximum of 10 hours of work per day including overtime is allowed.
The reservation bill was also controversial :&nbsp;
The Karnataka government approved a bill related to reservation in private sector jobs. If the bill becomes law, private companies doing business in Karnataka will have to give 50 percent to 100 percent reservation to Kannada speakers. Later the government banned this bill. The proposed bill prepared by the state labor department claimed that the jobs concerned were being given mainly to people from northern states. However, the bill was shelved due to opposition. Before Karnataka, Haryana and Andhra Pradesh also tried to implement similar reservation for locals in the private sector. The law could not be implemented in Haryana and Andhra Pradesh due to legal challenges.

કર્ણાટકમાં IT કર્મચારીઓ માટે દરરોજ 14 કલાક કામ કરવાની જોગવાઈ કરતા બિલ પર સરકારે યુ-ટર્ન લીધો છે. શ્રમ મંત્રી સંતોષ લાડે સ્પષ્ટતા કરી કે ટેક સેક્ટરના લોકો વધુ કલાકો કામ કરે તે માટે આઈટી ઈન્ડસ્ટ્રીઝ તરફથી કાયદો બનાવવાનું દબાણ છે.
પરંતુ તેઓ આ બાબતનું મૂલ્યાંકન કરી રહ્યા છે. લાડે કહ્યું કે સરકાર હજુ બિલની તપાસ કરી રહી છે. જે સોફ્ટવેર પ્રોફેશનલ્સને દૈનિક 14 કલાક કામ કરવાની ફરજ પાડશે. 
ભાજપ આ બિલનો વિરોધ કર્યો છે. ભાજપનું કહેવું છે કે આ મુદ્દે ચર્ચા કરવાની જરૂર છે. સરકાર એકપક્ષીય નિર્ણય લઈ શકે નહીં. આઈટી સેક્ટરના કર્મચારીઓ અને ટ્રેડ યુનિયનોએ પહેલાથી વિરોધ કર્યો છે. વિરોધના કારણે સરકાર બિલ પર કોઈ નિષ્કર્ષ પર પહોંચી શકી નથી. 
આઈટી કર્મચારીઓમાં નારાજગી :
સંતોષ લાડે કહ્યું કે, હું ઇચ્છું છું કે તમામ ઔદ્યોગિક વડાઓ આ અંગે ચર્ચા કરે. કારણકે આ મુદ્દો પબ્લિક ડોમેનમાં છે. લોકો તેમના મંતવ્યો વ્યક્ત કરવા સ્વતંત્ર છે. મામલો જગજાહેર બન્યો હોવાથી આઈટી કર્મચારીઓમાં અસંતોષ જોવા મળી રહ્યો છે. 
તેમણે ઉમેર્યુ કે હું ઈચ્છું છું કે લોકો તેમના મંતવ્યો શેર કરે. તેના આધારે અમે ચોક્કસપણે ધ્યાન આપીશું. મંત્રીએ કહ્યું કે IT કંપનીઓ, માલિકો અને ડિરેક્ટરોએ આગળ આવવું જોઈએ અને વર્ક-લાઈફ બેલેન્સના મુદ્દા પર ચર્ચા કરવી જોઈએ. પ્રતિસાદ હકારાત્મક હોય કે નકારાત્મક, સરકાર વિચારશે કે શું કરવાની જરૂર છે.
નવા બિલમાં શું છે ? :
રાજ્ય સરકાર 'કર્ણાટક શોપ્સ એન્ડ કોમર્શિયલ એસ્ટાબ્લિશમેન્ટ એક્ટ, 1961'માં સુધારો કરવાની યોજના બનાવી રહી છે. નવા બિલમાં IT/ITES/BPO સેક્ટરમાં કામ કરતા કર્મચારીઓને દિવસમાં 12 કલાકથી વધુ કામ કરવાની છૂટ આપવામાં આવશે.
દર અઠવાડિયે&nbsp;70 કલાક કામ કરી શકાશે. સતત ત્રણ મહિનામાં 125 કલાકથી વધુ કામ કરવાની મંજૂરી આપી શકાય નહીં. જોકે તેમાં સ્પષ્ટ ઉલ્લેખ નથી. કર્ણાટક સ્ટેટ IT/ITES એમ્પ્લોઈઝ યુનિયનના (KITU) અનુસાર નવું સંશોધન બિલ દરરોજ 14 કલાક કામ કરવાની મંજૂરી આપે છે. તેનાથી હાલના કાયદામાં સંપૂર્ણ ફેરફાર થશે. હાલમાં ઓવરટાઇમ સહિત દૈનિક મહત્તમ 10 કલાક કામ કરવાની છૂટ છે.
આરક્ષણ બિલનો પણ વિવાદ થયો હતો :
કર્ણાટક સરકારે ખાનગી ક્ષેત્રની નોકરીઓમાં આરક્ષણ સંબંધિત બિલને મંજૂરી આપતાં વિવાદ સર્જાયો હતો. આ બિલ કાયદો બની જાય તો કર્ણાટકમાં વ્યવસાય કરતી ખાનગી કંપનીઓએ કન્નડ બોલનારાઓને 50 ટકાથી 100 ટકા અનામત આપવી પડશે.
બાદમાં સરકારે આ બિલ પર પ્રતિબંધ લગાવી દીધો હતો. રાજ્યના શ્રમ વિભાગ દ્વારા તૈયાર કરાયેલા પ્રસ્તાવિત બિલમાં દાવો કરવામાં આવ્યો હતો કે સંબંધિત નોકરીઓ મુખ્યત્વે ઉત્તરી રાજ્યોના લોકોને આપવામાં આવી રહી છે.
જો કે, વિરોધ થતાં બિલને સ્થગિત કરાયુ છે. કર્ણાટક પહેલા હરિયાણા અને આંધ્રપ્રદેશે પણ ખાનગી ક્ષેત્રમાં સ્થાનિકો માટે સમાન અનામત લાગુ કરવાનો પ્રયાસ કર્યો હતો. કાયદાકીય રીતે પડકારતાં હરિયાણા અને આંધ્રપ્રદેશમાં કાયદાનો અમલ થઈ શક્યો નથી.

कर्नाटक में सॉफ्टवेयर पेशेवरों से प्रतिदिन 14 घंटे काम कराने वाले विधेयक पर बहस तेज हो गई है। बीजेपी ने कांग्रेस की सिद्धारमैया सरकार पर हमला बोला तो सरकार बैकफुट पर नजर आ रही है. श्रम मंत्री ने कहा कि हम पर आईटी इंडस्ट्री का दबाव है.
लेकिन हम इसका मूल्यांकन करेंगे और निर्णय लेंगे।' कर्नाटक में आईटी कर्मचारियों के लिए 14 घंटे कार्य दिवस प्रदान करने वाले विधेयक पर सरकार ने यू-टर्न ले लिया है।
श्रम मंत्री संतोष लाड ने स्पष्ट किया कि आईटी उद्योगों की ओर से तकनीकी क्षेत्र के लोगों के लिए अधिक घंटे काम करने के लिए कानून बनाने का दबाव है। लेकिन वे मामले का मूल्यांकन कर रहे हैं. लैड ने कहा कि सरकार अभी भी विधेयक की जांच कर रही है।
जो सॉफ्टवेयर पेशेवरों को प्रतिदिन 14 घंटे काम करने के लिए मजबूर करेगा। बीजेपी ने इस बिल का विरोध किया है. बीजेपी का कहना है कि इस मुद्दे पर चर्चा की जरूरत है. सरकार एकतरफ़ा फैसला नहीं ले सकती. आईटी सेक्टर के कर्मचारी और ट्रेड यूनियन पहले ही विरोध कर चुके हैं. विरोध के चलते सरकार बिल पर किसी नतीजे पर नहीं पहुंच सकी.
आईटी कर्मचारियों में नाराजगी :&nbsp;
संतोष लाड ने कहा, मैं चाहता हूं कि सभी औद्योगिक प्रमुख इस पर चर्चा करें। क्योंकि ये मामला पब्लिक डोमेन में है. लोग अपनी राय व्यक्त करने के लिए स्वतंत्र हैं।
मामला सार्वजनिक होने से आईटी कर्मचारियों में नाराजगी देखी जा रही है. उन्होंने कहा कि मैं चाहता हूं कि लोग अपने विचार साझा करें। उसके आधार पर हम जरूर ध्यान देंगे. मंत्री ने कहा कि आईटी कंपनियों, मालिकों और निदेशकों को आगे आना चाहिए और कार्य-जीवन संतुलन के मुद्दे पर चर्चा करनी चाहिए। चाहे फीडबैक सकारात्मक हो या नकारात्मक, सरकार इस पर विचार करेगी कि क्या करने की जरूरत है।
नये बिल में क्या है ? : 
राज्य सरकार 'कर्नाटक दुकानें और वाणिज्यिक प्रतिष्ठान अधिनियम, 1961' में संशोधन करने की योजना बना रही है। नया बिल आईटी/आईटीईएस/बीपीओ क्षेत्र में काम करने वाले कर्मचारियों को प्रतिदिन 12 घंटे से अधिक काम करने की अनुमति देगा। प्रति सप्ताह 70 घंटे काम किया जा सकता है.
लगातार तीन महीनों में 125 घंटे से ज्यादा काम करने की इजाजत नहीं दी जा सकती. हालाँकि, इसका स्पष्ट उल्लेख नहीं किया गया है। कर्नाटक राज्य आईटी/आईटीईएस कर्मचारी संघ (केआईटीयू) के अनुसार, नया संशोधित बिल प्रति दिन 14 घंटे काम की अनुमति देता है। इससे मौजूदा कानून पूरी तरह बदल जाएगा. वर्तमान में ओवरटाइम सहित प्रति दिन अधिकतम 10 घंटे काम की अनुमति है।
