The recent reassignment of Allahabad High Court Judge Shekhar Yadav, following his contentious public remarks, raises critical concerns about judicial impartiality and the interplay between judiciary and politics in India. Judge Yadav, now tasked with hearing "First Appeals," was shifted from his previous role handling sensitive bail pleas in sexual harassment cases. This roster change, occurring just two days after his controversial statements at a Vishwa Hindu Parishad event, signals a deeper issue.
On December 8, addressing a public gathering organised by the VHP Legal Cell, Judge Yadav remarked, &ldquo;The country would function according to the wishes of the majority (Bahusankhyak) in India.&rdquo; He went further, making derogatory comments about the Muslim community, sparking widespread criticism. Such statements stand in stark contrast to the judiciary's mandate of upholding constitutional values, including equality and secularism.
Breach of Judicial Values
Judicial ethics in India are governed by frameworks such as the Restatement of Values of Judicial Life (1997), which emphasise that justice must not only be impartial but also visibly so. The principle of maintaining an aloofness from political or sectarian influences is central to preserving the judiciary's credibility. Yet recent incidents suggest an erosion of these principles.
Judge Yadav's comments drew parallels to broader patterns in the judiciary, where political alignments and personal beliefs have surfaced, influencing judicial conduct. Instances like these erode public trust and challenge the judiciary's role as the protector of constitutional values.
A Worrying Pattern
This is not an isolated event. The judiciary has faced similar controversies in recent years. Former Chief Justice of India Ranjan Gogoi's nomination to the Rajya Sabha by the ruling government raised questions about post-retirement appointments and their implications on judicial independence. Similarly, Calcutta High Court Judge Abhijit Gangopadhyay's resignation to join a political party ahead of elections stirred debates on the "cooling-off period" for judges transitioning into political roles.
Even Chief Justice DY Chandrachud, who emphasised the need for maintaining judicial neutrality, faced criticism for inviting political figures to private events. The juxtaposition between the judiciary's principles and such actions creates a sense of ambiguity regarding its impartiality.
Historical Context and the Current Shift
The deterioration of judicial independence is not recent. In 2017, Justice Abhay Thipsay of the Allahabad High Court joined the Congress party, highlighting an ongoing trend where judicial appointments and post-retirement roles appear influenced by political ideologies. Such alignments jeopardise the constitutional principle of separation of powers and the checks-and-balances system.
Decades ago, Chief Justice MN Venkatachaliah asserted to then-Prime Minister Narasimha Rao that &ldquo;the relationship between the judiciary and executive has to be correct, not cordial.&rdquo; This doctrine underscores the judiciary&rsquo;s responsibility to act independently, without favouring the executive. However, today, the interdependence between the two branches seems more symbiotic than distinct, with mutual interests often at play.
Broader Implications
Globally, concerns over judicial politicisation are not unique to India. In the United States, debates about the ideological leanings of federal judges have similarly sparked controversies. However, the pressing issue for India is safeguarding its pluralistic ethos. Judge Yadav&rsquo;s assertion that the country should function as per the "majority's wishes" challenges the inclusive ideals enshrined in the Constitution and jeopardises the spirit of Vasudhaiva Kutumbakam&mdash;the idea of the world as one family.
As Shyama Prasad Mukherjee aptly stated during the Constituent Assembly debates, &ldquo;Unity in diversity is India's key note and must be achieved by a process of understanding and consent.&rdquo; Straying from this vision risks undermining the democratic fabric of the nation.
Observation
The judiciary&rsquo;s role as an impartial arbiter is indispensable to democracy. Judges must rise above political, ideological, and personal biases to maintain public trust and preserve constitutional values. The recent developments, including Judge Yadav&rsquo;s remarks and other instances of judicial-politico convergence, call for introspection and reform to uphold the sanctity of India's judiciary.
