The Delhi High Court has made it clear that a husband cannot use his wife&rsquo;s inherited property, family gifts, or parental wealth as a reason to deny her financial support.
The ruling came while the court was examining a challenge to an order directing a man to pay ₹50,000 per month to his wife as interim maintenance. The husband had argued that his wife did not need support because she had assets and financial backing from her family. The court rejected this claim.
Justice Swarana Kanta Sharma observed that financial support must be decided based on a woman&rsquo;s present ability to support herself and the standard of living she enjoyed during the marriage. The financial status of her parents or relatives, the court said, is irrelevant in deciding her entitlement.
The court noted that property inherited by a woman or gifts received from her family cannot be treated as her income. Such assets, it said, do not automatically provide her with a steady means to sustain herself.
At the same time, the court underlined that a husband&rsquo;s ability to pay support is not limited to a fixed salary. It includes income from business activities, family-run enterprises, and any financial benefit he may receive from such ventures. The objective, the court said, is to ensure that the wife is able to live with dignity and financial security.
The couple in the case married in December 2018 but later fell into dispute. The wife approached the court alleging abuse and financial neglect and sought financial support. The husband opposed the request, claiming unemployment and stating that the wife was financially independent due to her family background.
However, the court found gaps in his claim. A review of his financial records showed regular transactions in previous years and spending patterns that did not match his assertion of financial distress.
The court also rejected the argument that the wife&rsquo;s education alone proved she could earn enough to support herself. It said that theoretical earning potential cannot replace actual income when deciding financial support.
Upholding the earlier orders, the High Court ruled that the monthly amount of ₹50,000 was fair and reasonable in the circumstances. It also clarified that the sum would cover the wife&rsquo;s housing expenses.
