The Calcutta High Court on Tuesday ordered Indian cricketer Mohammed Shami to pay ₹1.5 lakh per month as interim maintenance to his estranged wife Hasin Jahan, along with ₹2.5 lakh for the care and expenses of their minor daughter.
A Bench comprising Justice Ajoy Kumar Mukherjee was hearing an appeal filed by Hasin Jahan, challenging an earlier order by the Alipore Sessions Judge, who had directed Mohammed Shami to pay ₹50,000 per month to Hasin Jahan and ₹80,000 to their daughter as interim monetary relief.
Hasin Jahan's appeal contended that the Alipore Sessions Judge had &ldquo;mechanically&rdquo; granted &ldquo;inadequate and insufficient&rdquo; interim relief, despite her meagre monthly income of ₹16,000 and an alleged monthly expenditure of nearly ₹6 lakh.
The appeal further stated that due to her financial constraints, she had been unable to enrol her daughter in a reputed school comparable to those attended by children of other Indian cricketers.
Her counsel urged the Calcutta High Court to consider granting interim monetary relief in light of Mohammed Shami&rsquo;s financial capacity, his income, lifestyle, and the rising cost of living.
Conversely, Mohammed Shami&rsquo;s lawyer argued that Hasin Jahan had acquired property through her earnings from modelling, acting, and business activities, and falsely portrayed herself as a destitute person.
After hearing the submissions, the Bench led by Justice Mukherjee observed: &ldquo;[T]he quantum of interim monetary relief as fixed by the Court below requires revision. The opposite party/husband&rsquo;s income, financial disclosures and earnings establish that he is in a position to pay a higher amount. The petitioner&rsquo;s wife, who has remained unmarried and is independently raising the child, is entitled to a standard of maintenance consistent with the lifestyle she enjoyed during the marriage and that reasonably secures her and the child&rsquo;s future.&rdquo;
In her appeal, Hasin Jahan sought monthly interim relief of ₹7 lakh for herself and ₹3 lakh for her minor daughter.
According to her original application under the Protection of Women from Domestic Violence Act, 2005, Hasin Jahan and her daughter were allegedly subjected to significant physical and mental harassment by Mohammed Shami and his family members.
Following her complaint, an FIR was filed against Mohammed Shami and his relatives under Sections 498A, 328, 307, 376, 325, read with Section 34 of the Indian Penal Code (IPC).
Hasin Jahan and Mohammed Shami were married in 2014 according to Islamic customs, and were blessed with a daughter the following year. This was Hasin Jahan&rsquo;s second marriage; she has two daughters from her previous marriage.
