The long-running trademark tussle between IndiGo Airlines and Mahindra Electric is headed to trial after mediation talks between the two companies failed. The Delhi High Court has now listed the case for hearing on February 3, 2026, setting the stage for a legal showdown over the use of the &lsquo;6E/6e&rsquo; mark.
The dispute began when InterGlobe Aviation Ltd, which operates IndiGo Airlines, filed a suit alleging that Mahindra Electric&rsquo;s use of the name &ldquo;BE 6e&rdquo; for its electric vehicle infringed on IndiGo&rsquo;s registered trademark &ldquo;6E.&rdquo; The airline argued that the mark &ldquo;6E&rdquo; is not only its official callsign but also central to its brand identity across multiple services including 6E Prime, 6E Flex, and other &ldquo;6E&rdquo; branded products that offer priority check-in, seat selection, extra baggage, and pre-booked meals.
IndiGo, which secured registration for the mark &ldquo;6E Link&rdquo; in 2015 under Classes 9, 16, 35, and 39 covering advertising materials, signage, and transport services contends that Mahindra&rsquo;s adoption of &ldquo;BE 6e&rdquo; unlawfully capitalises on its established reputation.
The Registrar of Trademarks had earlier accepted Mahindra Electric&rsquo;s application to register &ldquo;BE 6e&rdquo; under Class 12, which covers motor vehicles and related components. This prompted IndiGo to take the matter to court.
During earlier hearings, Mahindra informed the court that it had voluntarily rebranded its car as &ldquo;BE 6&rdquo; and would refrain from using &ldquo;BE 6e&rdquo; until the case was resolved. Despite this assurance, mediation efforts failed to yield a settlement.
The Joint Registrar of the Delhi High Court has now directed both parties to submit relevant documents and a joint schedule before the trial begins. Meanwhile, separate opposition proceedings against Mahindra&rsquo;s claim to the &lsquo;6e&rsquo; mark remain pending before the trademark registry.
