The Allahabad High Court has transferred a complaint against Congress leader Rahul Gandhi from Raebareli to Lucknow, citing concerns raised by the complainant about being unable to argue the matter freely.
The order was passed after the complainant claimed that supporters of Gandhi were preventing him from presenting his case in the Raebareli court. He also alleged that repeated disturbances were being created by a &ldquo;mob and advocates of District Raebareli&rdquo;, noting that Gandhi is the sitting Member of Parliament from the constituency.
Taking note of these claims, the Court observed,&nbsp; "The applicant has made allegation that the opposite party No.4 is a sitting Member of Parliament (Lok Sabha) from Raebareli constituency, therefore, in the light of the aforementioned facts, he prays that the case may be transferred to some other District. In view of the aforesaid factual aspects, I find that in all fairness the application is liable to be transferred from District Raebareli to Lucknow." 
The Court accordingly directed that the complaint be shifted from the Raebareli court to the designated court handling cases involving Members of Parliament and Members of Legislative Assemblies in Lucknow.
Notably, the Court passed the transfer order without issuing notice to Gandhi. This followed the complainant&rsquo;s argument that the Congress leader was not yet an affected party, as no direction had been issued for registration of a police case at that stage.
The complaint, filed by S Vignesh Shishir, seeks a criminal investigation into allegations that Gandhi holds British citizenship. Shishir claims that Gandhi was associated with a UK-based company and had declared his nationality as British in its records.
After the police did not act on the complaint, Shishir approached the trial court. He had also earlier written to the Union government seeking cancellation of Gandhi&rsquo;s Indian citizenship on the same grounds.
In a related development earlier this year, the High Court had directed the Union government to provide round-the-clock security to the complainant, citing concerns for his safety.
