The Supreme Court will on Monday pronounce its order on whether to suspend the Waqf (Amendment) Act, 2025, nearly four months after reserving its verdict on a batch of 21 petitions challenging the law.
A bench of Chief Justice Bhushan R Gavai and Justice A G Masih will deliver the ruling on September 15. Arguments on the petitions concluded in May, after which the court reserved its order on May 22.
The case has drawn attention after the Union government, through a June 6 notification, mandated registration of all waqf properties on the centralised UMEED portal within six months. On August 22, the bench had refused to stay the notification, saying interim orders could not be passed once judgment was reserved.
Petitioners led by senior advocate Kapil Sibal argued that the law unfairly shifts the burden of registration onto custodians, punishing the Muslim community for the state&rsquo;s failure to survey waqf properties since 1954. They also opposed provisions restricting dedication of waqf to practising Muslims of five years and barring waqf creation on tribal land.
Defending the amendments, Solicitor General Tushar Mehta said the changes enhance transparency, curb misuse, and protect vulnerable communities. Supporters of the law cited instances where vast tracts of land were allegedly claimed as waqf without accountability.
The outcome of Monday&rsquo;s ruling is expected to have significant implications for waqf property management and the future of the 2025 law.
