The Supreme Court will today hear applications seeking the restoration of Jammu and Kashmir&rsquo;s statehood within a fixed timeframe. The matter will be taken up by a Bench comprising CJI B.R. Gavai and Justice K. Vinod Chandran, as per the court&rsquo;s causelist.
The petitions, filed by Zahoor Ahmed Bhat and activist Khurshaid Ahmad Malik, argue that the prolonged delay in restoring statehood is harming citizens&rsquo; rights and violating the principle of federalism, which forms part of the Constitution&rsquo;s Basic Structure.
In its landmark Article 370 verdict, a five-judge Constitution Bench led by former CJI D.Y. Chandrachud upheld the Centre&rsquo;s decision to abrogate Article 370 and convert J&amp;K into a Union Territory, while noting the government&rsquo;s assurance given by Solicitor General Tushar Mehta that statehood would be restored. However, no timeline was specified.
The verdict also directed the Election Commission of India to hold Assembly polls in J&amp;K by September 30, 2024 and upheld Ladakh&rsquo;s Union Territory status. In May 2024, the SC dismissed review petitions against this ruling.
Today&rsquo;s hearing will address whether a time-bound framework for restoration is necessary.
