The Allahabad High Court has stayed an Economic Offences Wing (EOW) probe into 558 aided madrassas in Uttar Pradesh. The investigation, directed by the National Human Rights Commission (NHRC) following a complaint by Mohammad Talha Ansari, alleged violations of human rights.
A petition challenging both the NHRC&rsquo;s orders from February 28 and June 11, as well as a government order of April 23 authorising the inquiry, was filed before the court. The bench of Justices Saral Srivastava and Amitabh Kumar Rai issued a notice to the NHRC and the complainant, fixing November 17 as the next hearing.
The petition argued that the NHRC&rsquo;s inquiry exceeds its jurisdiction under the Protection of Human Rights Act, 1993. Sections 12 and 36 of the Act outline the commission&rsquo;s functions and limit inquiries to within one year of the alleged violation. Section 12-A allows inquiries only under specific conditions, none of which apply in this case.
The petitioner also highlighted that the complaint did not specify the date of the alleged violations, making it impossible to determine if the NHRC&rsquo;s action was timely. The court has directed respondents to submit their replies within four weeks.
