The Gujarat High Court has dismissed a petition filed by the trustees of the approximately 400-year-old Mansa Mosque, challenging the Ahmedabad Municipal Corporation&rsquo;s (AMC) plan to demolish part of the mosque for road widening in Saraspur. The court held that the Waqf Act provisions could not be applied in this case, as the municipal commissioner exercised special powers under the Gujarat Provincial Municipal Corporation (GPMC) Act.
The mosque trust had opposed the issuance of notices to vacate and demolish part of the mosque structure, arguing that it is protected as Waqf property and forms part of the city&rsquo;s religious and cultural heritage. The trust also contended that proper hearings under the Waqf Act were not conducted before issuing the notices.
The state government justified the project, noting that the road expansion connecting Kalupur Railway Station and Ahmedabad Metro Junction is essential for traffic management and urban development. The government confirmed that all legal procedures under the GPMC Act were followed, and special powers were used appropriately.
The High Court emphasised that the project serves the public interest and that AMC complied with the legal process. Both the trust&rsquo;s petition and the request for a four-week stay on the notices were rejected, allowing the partial demolition and road widening work to proceed.
