The Bombay High Court has ordered the immediate takedown of morphed, AI-generated and deepfake content allegedly misusing the image and likeness of Shilpa Shetty Kundra, observing that such material is prima facie disturbing and infringes upon an individual&rsquo;s fundamental right to privacy and dignity.
Granting interim relief, a vacation bench of the Bombay High Court remarked that no personality should be portrayed in a manner that adversely affects their right to privacy, irrespective of public status. The court directed online platforms, websites and unknown persons involved in circulating the content to immediately remove and disable access to the offending images, videos, links and URLs.
The bench noted that the alleged content involved manipulated visuals and deepfakes created using artificial intelligence and circulated without consent. Describing the material as &ldquo;prima facie extremely disturbing and shocking,&rdquo; the court said such portrayals can cause serious harm to reputation, dignity and personal autonomy.
Shilpa Shetty had approached the court seeking protection of her personality and privacy rights, alleging unauthorised digital manipulation and online dissemination of her image. Her plea argued that the misuse amounted to unlawful exploitation of her persona and violated her right to control how her identity and likeness are represented in the public domain.
While ordering urgent interim relief, the court clarified that broader questions relating to personality rights and publicity rights would be examined by a regular bench at a later stage. The present order, it said, was confined to preventing further harm.
The ruling highlights increasing judicial concern over the misuse of AI tools to create deepfake and morphed content, reinforcing that technological innovation cannot override constitutional protections of privacy and dignity.
