The Supreme Court on Thursday ruled that the recent Bombay High Court judgment acquitting 12 accused in the 2006 Mumbai train bombings will not serve as a binding precedent in other cases under the Maharashtra Control of Organised Crime Act (MCOCA).
A bench of Justices M.M. Sundresh and N. Kotiswar Singh issued this clarification after Solicitor General Tushar Mehta argued that the ruling could impact ongoing trials under MCOCA. The apex court also issued notice on the Maharashtra government&rsquo;s plea challenging the Bombay High Court verdict.
The High Court&rsquo;s decision on July 22 led to the immediate release of 12 individuals &mdash; five previously sentenced to death and seven to life imprisonment. They had been imprisoned for 19 years.
The Bombay HC criticised the investigation, stating the prosecution failed to prove the type of explosives used and relied on coerced confessions, rendering them inadmissible.
The July 11, 2006, serial bomb blasts on Mumbai&rsquo;s suburban trains killed 189 people and injured over 800 in just 11 minutes. A 2015 special court had convicted 12, citing links to Pakistan&rsquo;s ISI, Lashkar-e-Taiba, and banned outfit SIMI.
The Supreme Court has now taken up the case for further scrutiny, with Solicitor General Mehta calling it a &ldquo;serious matter&rdquo; needing top court intervention.
