As states gear up for this transformation, preparations are underway with training sessions arranged for bureaucrats, judges, and police personnel across the country.
However, a significant hurdle remains unresolved: the absence of official translations of these laws in regional languages. From Kerala, Karnataka, and Tamil Nadu to Odisha and West Bengal, local translations are crucial to ensure accessibility at police stations, trial courts, and prisons. The delay in regional notifications poses a challenge to the effective implementation of these reforms, highlighting the need for swift action to bridge this linguistic gap."
It has been revealed that in March, three months after the passage of the laws, the Centre communicated with states regarding the translation of the Bharatiya Nyaya (Second) Sanhita, 2023 (new IPC), Bharatiya Nagarik Suraksha (Second) Sanhita, 2023 (new CrPC), and Bharatiya Sakshya (Second) Act, 2023 (new Evidence Act) into scheduled languages. These laws, which received Presidential assent in December last year in their Hindi and English versions, fall under Central legislation despite criminal laws generally being on the concurrent list.
Among the 22 scheduled languages, initial translation requirements for the new laws include Tamil, Kannada, Marathi, Gujarati, Bengali, and Punjabi, totaling 13 languages. Notably, languages such as Dogri and Santhali, though official, are not typically used in legal proceedings.
Anup Surendranath, Professor of Law at the National Law University, Delhi, emphasized the critical need for local translations of these laws. He highlighted that such translations are essential both as a democratic right and for effective bureaucratic implementation across the diverse regions of India.
"Incorporating these laws solely in English and Hindi does not suffice for ensuring comprehensive access within the vast bureaucratic infrastructure spread across the nation," he remarked. "For millions of citizens, the practical application of criminal law often hinges on the familiarity of local law enforcement personnel, such as police constables and investigating officers. It is imperative that these personnel have access to these laws in their respective regional languages as the foundational step towards their comprehension."
In Karnataka, HK Patil, the state's Law and Parliamentary Minister, indicated that the Karnataka Police Academy (KPA) has taken initial steps by translating the laws into Kannada and producing instructional materials for police personnel.
"The version produced by the Karnataka Police Academy will not hold official status; the final and authoritative translated version will be the one published in the gazette," remarked State Law and Parliamentary Affairs Minister HK Patil.
Meanwhile, in Punjab, Home Secretary Gurkirat Kirpal confirmed that the government is currently undertaking the translation of the laws into Punjabi.
In Kerala, State Law Secretary K G Sanal Kumar has stated that the state government has formally requested consent from the Union Ministry to translate the laws into Malayalam. "We are awaiting approval from the Centre to proceed with the translation of these laws into the local language. Once we receive clearance, the state will initiate the necessary steps for translation," he affirmed

राज्य के विधि एवं संसदीय कार्य मंत्री एच.के. पाटिल ने कहा, "कर्नाटक पुलिस अकादमी द्वारा तैयार किया गया संस्करण आधिकारिक दर्जा नहीं रखेगा; अंतिम और प्रामाणिक अनुवादित संस्करण ही राजपत्र में प्रकाशित किया जाएगा।"
