The Karnataka High Court has overturned an externment order issued against activist Mahesh Shetty Thimarody, who has been a prominent voice in the contentious Soujanya death case and alleged mass grave controversy involving Dharmasthala temple authorities. The order, passed by a Bench led by Justice Suraj Govindaraj, directed the authorities to conduct a fresh inquiry and issue a new order, citing valid grounds and legal sections, within 15 days.
Thimarody was externed from Mangaluru to Raichur for one year in September, based on a report by the Bantwal DySP. This action was part of proceedings against 36 individuals aimed at maintaining law and order in the district. Challenging the order, Thimarody accused the state administration of acting prejudicially and failing to substantiate the criminal cases used as justification, stating he had been acquitted in most of them.
The state had defended its decision, asserting the externment followed due process and did not violate natural justice. However, the court&rsquo;s ruling now grants Thimarody temporary relief, barring coercive action while the matter undergoes re-evaluation. The court&rsquo;s directive underscores the need for transparency and specificity in such restrictive orders.
Thimarody has been a leading activist in the 2012 Soujanya case, where a 17-year-old college student was found murdered near Dharmasthala. Activists, including Thimarody, have long alleged foul play and cover-up, accusing temple authorities of involvement. The case continues to spark protests and demands for thorough, unbiased investigation.
