The Bombay High Court has clarified that Aadhaar cards, PAN cards, and voter IDs are not definitive proof of Indian citizenship. The observation came while rejecting the bail plea of Babu Abdul Ruf Sardar, accused of being a Bangladeshi national living in India illegally.
The court said these identity documents are meant for identification, not as legal confirmation of citizenship, and can be obtained through forged or falsified records. Citizenship, it stressed, is established only under the Citizenship Act, 1955, and constitutional provisions, not merely by possession of government-issued IDs.
Sardar allegedly entered India without valid travel documents and used fake papers to secure Aadhaar, PAN, and voter IDs. Given the gravity of the charges and risk of evidence tampering, the bench denied bail.
The ruling underscores the legal distinction between having identity cards and proving citizenship, warning that reliance on IDs alone can be misleading.
