In what could become one of the most significant legal battles of his presidency, Donald Trump faces a Supreme Court challenge questioning his power to impose tariffs on foreign goods. Leading the charge is Neal Katyal, a prominent Indian-origin constitutional lawyer often dubbed the &ldquo;Trump Tormentor.&rdquo;
The Supreme Court will hear arguments that may redefine presidential authority over trade and impact trillions of dollars in global commerce. Small businesses are contesting Trump&rsquo;s sweeping tariff policy, claiming it was imposed unlawfully.
Neal Katyal, who represents the petitioners, is no stranger to the highest court. At 55, he has argued more than 50 cases before the U.S. Supreme Court more than any minority attorney in American history. A Yale Law School graduate and former acting Solicitor General under President Obama, Katyal has a history of handling landmark cases, including defending the constitutionality of the Voting Rights Act and representing the government in complex national security matters.
Born in Chicago to Indian immigrant parents, Katyal&rsquo;s rise in the American legal system has been marked by his meticulous constitutional arguments and his firm belief in the separation of powers. His previous battles with Trump include leading the fight against the controversial 2017 &ldquo;travel ban,&rdquo; where he succeeded in temporarily halting its implementation.
Now, Katyal represents small companies, including VOS Selections, a New York-based importer, that claim Trump exceeded his authority under the 1977 International Emergency Economic Powers Act (IEEPA). The law allows the president to act during national emergencies related to foreign threats, but Katyal argues it was never meant to justify blanket tariffs.
&ldquo;The president&rsquo;s claim of authority here is extraordinary,&rdquo; Katyal wrote in a filing, asserting that no president in 50 years has invoked the IEEPA for trade purposes.
The case could have sweeping consequences. The U.S. Justice Department is pushing to overturn lower court rulings that found Trump lacked the power to impose such tariffs, while Katyal&rsquo;s team is urging the Supreme Court to uphold those judgments.
The court has allocated 80 minutes for oral arguments, signaling the case&rsquo;s magnitude. Legal experts say the ruling could set a precedent on executive power in economic policy and reshape how trade is handled by future presidents.
Trump, calling it &ldquo;one of the most important cases in American history,&rdquo; has said the outcome will determine whether the U.S. remains a global economic powerhouse. &ldquo;If we lose, our country could be reduced to almost Third World status,&rdquo; he wrote on Truth Social, adding he will not attend the hearing to avoid distracting from the proceedings.
The Supreme Court&rsquo;s decision, expected early next year, could either reinforce presidential control over trade or return tariff authority to Congress, fundamentally altering the structure of U.S. economic governance.
