Court warns Arjuna: free speech has limits; small sparks may cause disaster

Madras HC rebukes TVK leader’s social post

The Madras High Court sharply questioned whether Adhava Arjuna, General Secretary and second-in-command of the Tamizhaga Vettri Kazhagam (TVK), was “above the law,” admonishing both the leader and the police for inaction despite an FIR over his controversial social media post.
During proceedings, Justice N. Senthilkumar asked pointedly: “Do people think nothing can be done to them? Do you want the court to be a mute spectator?” The remarks came in response to a petition filed by S. M. Kathiravan of Anna Nagar, seeking judicial intervention against Arjuna’s “Gen Z Revolution” post on X (formerly Twitter).
The Karur stampede occurred during a political rally organised by the Tamizhaga Vettri Kazhagam (TVK) in central Tamil Nadu. Thousands of supporters had gathered to hear party leaders, including General Secretary Adhava Arjuna. Overcrowding, sudden movement of the crowd, and inadequate crowd control measures led to panic, resulting in a stampede. Several people were reportedly injured, and local authorities had to intervene to restore order. The incident has raised concerns over public safety during mass political events and sparked debate over the responsibility of organisers to manage large gatherings effectively.

State prosecutors informed the bench that Arjuna had been booked under multiple sections of the Indian Penal Code. However, the judge expressed clear dissatisfaction at the authorities’ lack of further action. “Even a small spark can lead to a disaster. Can you allow anybody to speak anything? Is there no law and order? Very unfortunate,” he said, emphasising that freedom of speech is subject to reasonable restrictions.
Arjuna’s post, which reportedly encouraged youth mobilisation against the ruling DMK government in Tamil Nadu, has drawn widespread attention amid rising political tensions. While supporters view the content as a legitimate call for political engagement, critics—including the state administration—have flagged it as potentially inflammatory and capable of inciting unrest.
The court’s remarks signal a stern warning that social media rhetoric by political figures is under judicial scrutiny, particularly when it could lead to public disorder. Observers note that this case could set a precedent for how courts balance free expression against public safety in the digital age.
No further hearings have been scheduled, but authorities are expected to monitor similar online content closely.
