Ahmedabad: The Gujarat High Court on Friday pulled up the Rajkot municipal commissioner and refused to accept an affidavit submitted by his office. The reason for the court&rsquo;s rejection was the civic body&rsquo;s inability to take satisfactory steps to ensure fire safety in the city.
A high court division bench directed the commissioner to accept his fault and apologize. It further warned him not to tempt the court to read the affidavit submitted by the body. This direction led to the municipal commissioner withdrawing said affidavit.
In May this year, over 28 people, including 12 children, were killed in a fire that occurred at the TRP Mall in Rajkot. The Gujarat High Court took up a suo moto petition on this issue and sought a report on remedial action taken by the Rajkot Municipal Corporation (RMC) in respect of the order on fire safety passed by the HC in the past.
Expressing disatisfaction with the affidavit filed by the Rajkot municipal commissioner, the court observed that the commissioner cannot shirk responsibility and claim that he knows nothing.
The HC was also of the opinion that, as an officer, his responsibility extends to supervision of any building in use as well. It is his job to ensure whether any building has been granted BU permission or not. All responsibility pertaining to the issue and beyond it falls to him as well.
On further observation, the court strictly said, "It is not important whether the official commissioner was the one incharge when this action took place. You occupy that position now, so you have all responsibility." The division bench also questioned the commissioner about the directions given by the Gujarat HC, in the wake of the fire at Ahmedabad's Shreya Hospital. It also held that the commissioner cannot ignore an order of the high court.

અમદાવાદ: ગુજરાત હાઈકોર્ટે શુક્રવારે રાજકોટ મ્યુનિસિપલ કમિશનરની ઝાટકણી કાઢી હતી અને તેમની ઓફિસ દ્વારા રજૂ કરાયેલ એફિડેવિટ સ્વીકારવાનો ઇનકાર કર્યો હતો. કોર્ટના અસ્વીકારનું કારણ શહેરમાં ફાયર સેફ્ટી સુનિશ્ચિત કરવા માટે સંતોષકારક પગલાં લેવામાં નાગરિક સંસ્થાની અસમર્થતા હતી.
હાઈકોર્ટની ડિવિઝન બેન્ચે કમિશનરને તેમની ભૂલ સ્વીકારવા અને માફી માંગવા નિર્દેશ આપ્યો હતો. તેણે તેને વધુ ચેતવણી આપી હતી કે તે કોર્ટને બોડી દ્વારા સબમિટ કરવામાં આવેલ એફિડેવિટ વાંચવા માટે લલચાવશે નહીં. આ નિર્દેશને કારણે મ્યુનિસિપલ કમિશનરે એફિડેવિટ પાછી ખેંચી લીધી.
રાજકોટના ટીઆરપી મોલના લાગેલી આગમાં ૨૮ લોકોના મૃત્યુ થયાં હતાં, જેમાં ૧૨ બાળકોનો સમાવેશ થાય છે. આ મુદ્દે હાઇકોર્ટ સુઓમોટો પીટીશન હાથ પર લીધી હતી, જેમાં કોર્ટે મહાનગરપાલિકાએ ભૂતકાળમાં હાઇકોર્ટે કરેલા આદેશના સંદર્ભમાં શું પગલાં ભર્યા તેનો રિપોર્ટ માંગ્યો હતો, જે સંદર્ભમાં ફાઇલ થયેલી એફિડેવિટથી કોર્ટને અસંતોષ છે.
કોર્ટે એવું અવલોકન કર્યું કે કમિશનર પોતે કશું જાણતા નથી, તેવું નિવેદન કરી છટકી શકે નહીં. &nbsp;કોર્ટનું સ્પષ્ટ માનવું છે, એક અધિકારી તરીકે તેમની સુપરવિઝનની જવાબદારી છે, એ તેમની જવાબદારી માં આવે છે કે ધ્યાન રાખે વપરાશમાં આવતી ઇમારતને બીયુ પરમીશન અપાયું છે કે નહી, ભલે તે જવાબદારી પછી જે તે વિભાગની આવતી હોય.
વધુ અવલોકન કરતાં કોર્ટે કડક શબ્દોમાં કહ્યું કે આ કાર્યવાહી થઇ ત્યારે સત્તારૂઢ કમિશનર જવાબદારી સંભાળતા હતા કે નહીં, તે અગત્યનું છે જ નહી. તમે તે હોદ્દાને શોભાવો છો તેથી તમારી જવાબદારી છે. કોર્ટે કમિશનર સીધા સવાલ કર્યાં કે અમદાવાદ સ્થિત શ્રેય હોસ્પિટલમાં લાગેલી આગના પગલે, ગુજરાત હાઇકોર્ટે જે દિશા નિર્દેશ આપ્યા હતા. તે ધ્યાન લીધા હતા. કોર્ટનું સ્પષ્ટ માનવું છે કે કમિશનર હાઇકોર્ટના આદેશને નજર અંદાજ કરી શકે નહીં.

अहमदाबाद: गुजरात उच्च न्यायालय ने शुक्रवार को राजकोट नगर आयुक्त को बर्खास्त कर दिया और उनके कार्यालय द्वारा प्रस्तुत हलफनामे को स्वीकार करने से इनकार कर दिया। अदालत की अस्वीकृति का कारण शहर में अग्नि सुरक्षा सुनिश्चित करने के लिए नागरिक निकाय द्वारा संतोषजनक कदम उठाने में असमर्थता था। हाई कोर्ट की खंडपीठ ने कमिश्नर को अपनी गलती स्वीकार कर माफी मांगने का निर्देश दिया. उन्होंने आगे उन्हें आगाह किया कि वह अदालत को निकाय द्वारा प्रस्तुत हलफनामे को पढ़ने के लिए प्रेरित न करें। इस निर्देश के कारण नगर आयुक्त ने शपथ पत्र वापस ले लिया. राजकोट के टीआरपी मॉल में आग लगने से 12 बच्चों समेत 28 लोगों की मौत हो गई. इस मुद्दे पर हाई कोर्ट ने स्वत: संज्ञान याचिका दायर की, जिसमें कोर्ट ने पूर्व में हाई कोर्ट द्वारा पारित आदेश के संबंध में नगर पालिका द्वारा की गई कार्रवाई पर रिपोर्ट मांगी, जिसमें कोर्ट हलफनामे से असंतुष्ट है। इस संबंध में दायर किया गया।
कोर्ट ने कहा कि कमिश्नर खुद यह बयान देकर नहीं बच सकते कि उन्हें कुछ नहीं पता। न्यायालय की स्पष्ट राय है कि, एक अधिकारी के रूप में, पर्यवेक्षण की जिम्मेदारी उसकी जिम्मेदारी के अंतर्गत आती है कि वह यह देखे कि उपयोग में आने वाली इमारत को बीयू की अनुमति दी गई है या नहीं, भले ही यह जिम्मेदारी उस विभाग की हो। आगे की टिप्पणी पर अदालत ने सख्ती से कहा कि यह महत्वपूर्ण नहीं है कि जब यह कार्रवाई हुई तो आधिकारिक आयुक्त जिम्मेदारी निभा रहे थे या नहीं। आप उस पद पर हैं इसलिए आपकी जिम्मेदारी है। कोर्ट ने कमिश्नर से सीधे तौर पर सवाल किया कि अहमदाबाद के श्रेया हॉस्पिटल में लगी आग के बाद गुजरात हाई कोर्ट ने क्या निर्देश दिए थे. इस पर गौर किया गया. कोर्ट का स्पष्ट मानना है कि कमिश्नर हाईकोर्ट के आदेश को नजरअंदाज नहीं कर सकते।
